1. Acceptance of these terms

LaunchMyHVAC ("LaunchMyHVAC", "we", "us", or "our") is operated by Cheek Heating and Cooling LLC, an Indiana limited liability company. By creating an account, accessing, or using LaunchMyHVAC (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old and authorized to enter into a contract on behalf of any HVAC business or other entity for which you create an account.

2. The service

LaunchMyHVAC provides cloud-based field-service management software for HVAC contractors, including (without limitation) customer and equipment records, dispatch and scheduling, estimates and invoices, payment processing, membership management, and AI-powered diagnostics tools. Features available to you depend on your subscription plan.

We may add, modify, or remove features at any time. We will give reasonable advance notice of material removals affecting paid features.

3. Your account

You are responsible for (a) maintaining the confidentiality of your login credentials, (b) all activity that occurs under your account, and (c) ensuring your account information is accurate and current. You agree to notify us promptly at support@launchmyhvac.com if you suspect unauthorized access.

If you create accounts for your employees or technicians ("team members"), you represent that you have the authority to bind them to these Terms and our Privacy Policy, and you are responsible for their use of the Service.

4. Subscriptions, billing, refunds

  • Paid subscriptions are billed in advance on a recurring basis (monthly or annually) through our payment processor, Stripe.
  • LaunchMyHVAC charges platform subscription and processing fees only. We do not take a royalty or percentage of your parts margin.
  • You keep all customer revenue, labor margin, and parts margin from your jobs, subject to payment processor fees and your own business costs.
  • Subscription fees are non-refundable except where required by law. If you cancel mid-cycle, your subscription remains active through the end of the paid period and will not renew.
  • If a payment fails, we may suspend or downgrade your account until payment is received.
  • We may change pricing on at least 30 days' notice. Price changes apply to your next billing cycle after the notice period.
  • Free-tier (unpaid) accounts are provided "as available" with usage limits and may be paused, throttled, or discontinued at any time.

5. Your data & how we use it

You retain all rights to data you upload or generate in the Service ("Customer Data"), including your customers' information, photos, jobs, invoices, and notes. You grant us a worldwide, non-exclusive license to host, process, display, and transmit Customer Data solely as necessary to provide the Service to you.

We will not sell your Customer Data. We do not use Customer Data to train third-party AI models. We may use aggregated, de-identified data to improve the Service.

You are responsible for: (a) the legality and accuracy of Customer Data, (b) obtaining all necessary consents from your customers (especially for SMS and email marketing), and (c) complying with all applicable privacy laws (including but not limited to TCPA, CAN-SPAM, CCPA, and state-level privacy regulations).

6. Acceptable use

You agree not to:

  • Use the Service to violate any law, regulation, or third-party right;
  • Send unsolicited bulk email or SMS in violation of CAN-SPAM, TCPA, or any other anti-spam law;
  • Upload malware, viruses, or harmful code;
  • Attempt to gain unauthorized access to any portion of the Service or another customer's data;
  • Reverse-engineer, decompile, or copy any part of the Service except as expressly permitted by law;
  • Use the Service to compete with us or to build a competing product;
  • Resell, sublicense, or share your account access with parties outside your business.

7. Third-party services

The Service integrates with third-party providers including Stripe (payments), Resend (email), Twilio (SMS), Anthropic and OpenAI (AI features), and others. Your use of those features is also subject to those providers' terms. We are not responsible for third-party services' availability, accuracy, or content.

8. Our intellectual property

The Service, including its software, design, logos, and content (other than Customer Data), is owned by Cheek Heating and Cooling LLC and its licensors and is protected by U.S. and international intellectual-property law. You receive a limited, non-exclusive, non-transferable license to use the Service for your business during your active subscription. No other rights are granted.

9. Disclaimers & "as-is" service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT AI-GENERATED OUTPUT IS ACCURATE OR COMPLETE; IT IS A TOOL TO ASSIST YOU AND IS NOT A SUBSTITUTE FOR PROFESSIONAL JUDGMENT.

YOU ARE SOLELY RESPONSIBLE FOR EQUIPMENT SELECTION, LOAD CALCULATIONS, PERMIT COMPLIANCE, CODE COMPLIANCE, PARTS SELECTION, FINAL PRICING, AND WORKMANSHIP. THE SERVICE PROVIDES WORKFLOW TOOLS, NOT ENGINEERING OR LEGAL ADVICE, AND DOES NOT REPLACE LICENSED PROFESSIONAL REVIEW.

YOU REPRESENT THAT YOU HOLD ALL REQUIRED HVAC LICENSES, CERTIFICATIONS, AND INSURANCE FOR THE JURISDICTIONS WHERE YOU OPERATE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, EVEN IF ADVISED OF THE POSSIBILITY.

11. Indemnification

You agree to indemnify, defend, and hold harmless Cheek Heating and Cooling LLC and its officers, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your Customer Data, (c) your violation of these Terms or any law, or (d) your violation of any third-party right.

12. Termination

You may cancel your account at any time from your account settings. We may suspend or terminate your account immediately if you breach these Terms, fail to pay, or use the Service in a way that risks harm to us or others. You may request export of your data at any time during your active subscription and during the post-termination export period.

Unless a different period is required by law, Customer Data is retained for up to seven (7) years from account closure for operational and legal recordkeeping, and then purged on request or according to our retention schedule. Disaster-recovery backups may persist for up to 30 days after deletion.

13. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated by email and/or a notice in the Service at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

14. Governing law & disputes

These Terms are governed by the laws of the State of Indiana, USA, without regard to conflict-of-laws rules.

Any dispute, claim, or controversy arising from or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration venue is Delaware County, Indiana unless the parties agree otherwise. You waive any right to a jury trial and any right to participate in a class or representative action.
